The call

Birkenstock keeps growing double digits on its own factories and pricing power, with the German court ruling on design copyrightability as the one legal thread worth watching.

Birkenstock is a German footwear company best known for its thick-soled sandals and shoes that cost more than most competitors. The company has been around for 250 years, makes almost all its products in Europe, and keeps prices high on purpose, which gives it fat profit margins that bigger rivals like Crocs and Skechers have not been able to steal away. The biggest threat is not a competitor but a legal one: if European courts decide that Birkenstock's sandal design cannot be legally protected like a trademark or patent, then knockoff makers will find it much easier to copy the look and undercut the price.

Why
01
AI pressure: None apparent. Physical footwear manufacturing and brand heat don't run through software; AI doesn't touch how these shoes get made or sold. Could AI do the core job? Unlikely.
02
Bigger players: Crocs, Deckers (UGG/Hoka), Skechers. All three ship comfort footwear at scale but none has pulled share from Birkenstock despite years of trying. Could a giant copy it? Probably.
03
What protects it. 95% of production stays inside Birkenstock's own EU factories, so copycats can't match the fit or the supply chain, only the look.

Questions people ask
Is Birkenstock profitable in 2026?
Yes. Birkenstock posted FY2025 net profit of €348.3 million, up 82% year over year, on revenue of €2.10 billion (ended September 30, 2025). Q2 FY2026 net profit fell 22% YoY due to FX and tariff pressure, but the company remains solidly profitable with a 31.8% adjusted EBITDA margin in FY2025.
Who owns Birkenstock?
Private equity firm L Catterton, backed partly by Financière Agache (LVMH CEO Bernard Arnault's holding company), controls Birkenstock. L Catterton held roughly 54 to 62 percent of shares as of March 2026 filings, down from higher stakes at the 2023 IPO, having sold blocks including a $941 million sale in May 2025.
Could AI replace Birkenstock?
No. Birkenstock's core business is physical cork-footbed sandal manufacturing, with 95%+ of assembly in Germany and 90%+ of materials sourced in Europe as of February 2026. AI may touch customer service or demand forecasting, but no evidence exists of AI-driven substitution threatening its vertically integrated manufacturing or brand heritage.
Who is Birkenstock's biggest competitor?
Trade analysis (Modaes, June 2026) ranks Crocs and Deckers (UGG/Hoka) as larger-scale peers, with Crocs topping $4 billion in FY2025 revenue. None have taken market share from Birkenstock, which posted double-digit growth outpacing Crocs and Skechers in FY2025, per that same industry ranking.
Is Birkenstock's sandal design legally protected?
It's contested. Germany's Federal Court of Justice ruled on February 19, 2025 that Birkenstock's sandal designs are not copyright-protected because they're functional, not artistic. A Dutch court reached the opposite conclusion in November 2025, recognizing copyright for three models in a case against retailer Scapino, creating EU legal fragmentation.
