The call

Index survives by being the neutral alternative buyers need to avoid Google, but a live wiretap lawsuit and Magnite's CTV lead are testing how long that neutrality story holds.

Index Exchange runs the behind-the-scenes marketplace where websites sell ad space to advertisers. It is hard to replace because Google faces legal pressure to stay neutral and cannot simply take over (antitrust rules block it), and because AI bidding systems will need Index's platform to operate on rather than replace it. The one thing that could change everything is a lawsuit called Baker v. Index Exchange, where customers claim the company improperly shared their data with a Chinese-owned platform; a court allowed the case to move forward in June 2026, and if the customers win, copycat lawsuits could damage Index's reputation and business across the entire industry.

Why
01
AI pressure: AI/agentic bidding models (autonomous buy-side agents). Index built Index Cloud so AI bidding agents plug into it, but no proof yet that buyers pick it over Google or Magnite pipes. Could AI do the core job? Only partly.
02
Bigger players: Google Ad Exchange. Google is #1 or tied almost everywhere and only stays out of full dominance because antitrust scrutiny limits how hard it can squeeze rivals. Could a giant copy it? Probably.
03
What protects it. Publishers and regulators want a neutral, non-Google exchange, and that preference is what keeps buyers routing bids through Index.

Questions people ask
Is Index Exchange profitable in 2026?
Index Exchange is privately held and discloses no profit figures. In October 2025 it launched Dynamic Take Rates, which the company itself describes as revenue neutral or negative for Index, suggesting margin compression rather than confirmed profitability.
Is Index Exchange losing to Google in ad exchange market share?
Per Pixalate's SSP market share reports, Google Ad Exchange ties or leads for number one U.S. web SSP share in most quarters through 2024 to 2025, while Index Exchange's own web share swung from 9 percent in Q4 2024 to 18 to 19 percent by Q3 2025.
Could AI replace Index Exchange?
Index Exchange is positioning itself as infrastructure AI bidders plug into rather than a replacement target. It launched Index Cloud on April 21, 2026, a proprietary compute environment letting partners like Bedrock Platform and Chalice AI deploy models inside its exchange.
What is Index Exchange's biggest legal risk right now?
Baker v. Index Exchange (N.D. Ill., No. 25-cv-10517), a Wiretap Act class action tied to alleged data transfer to a Chinese owned platform. A judge denied Index's motion to dismiss on June 16, 2026, and law firms call it a bellwether likely to spawn copycat suits.
Who is Index Exchange's biggest competitor?
Magnite dominates CTV, holding 25 to 47 percent share on Roku as of Q2 2025 versus Index's weak CTV presence. On DSP spend coverage, Jounce Media ranked Index fourth at 75.6 percent as of March 2025, behind Magnite, PubMatic, and Google.
Is Index Exchange growing or cutting staff?
Index Exchange announced six senior leadership hires on August 26, 2025, including a Chief Customer Officer poached from The Trade Desk, spanning engineering, product, revenue, and brand marketing, signaling continued organizational investment rather than contraction.
